Reconstructing after the fact creates problems on multiple fronts:
Vendors may have updated or retrained the model since the original decision; the version that produced that decision no longer exists.
Logs may have been pruned per default retention policies, often after just 30 to 90 days.
Forensic reconstruction can run $50,000 to $200,000 in vendor and legal fees compared to a few thousand dollars a year for proactive logging.
Courts treat the absence of contemporaneous records as adverse inference, weakening your defense further.
Proactive logging avoids all of that. Reactive logging, by definition, can't.
Request bias audit reports from every vendor. Read them. Then run your own tests on your own data, because vendors test on their own data, which is curated to make them look good. Your hiring patterns are different, and so is your data.
Don't hesitate to ask the vendor directly: is this AI-led (the AI decides) or human-led (the AI recommends)?

A real AI vendor can describe their algorithm class (regression, classification, neural network, transformer), their training data sources, and their model update cadence. If they can't, treat the tool as automation in disguise and evaluate it at automation pricing, not AI pricing.
Then ask whether the deployment is AI-led (decisions made autonomously) or human-led (recommendations only). AI-led tools concentrate legal risk on you. For most enterprise HR use cases, human-led is the safer call in 2026, and that may change in 2028 as governance frameworks mature.
Finally, ask whether the vendor publishes a responsible AI position. Real AI vendors today publish a public stance on bias mitigation, training data ethics, human oversight, and customer right-to-audit.
